Arrested on Jan 19, 2021 Hernandez was out on bond when she caused a fatal crash. On Jan 5, 2022, Victoria Wilson was riding northbound on I-44 in a car with her husband, Ryan Wilson, as the pair drove toward their home in St. Clair. They were returning from Sullivan, where they had gone to celebrate their 15th wedding anniversary. As the couple drove north, Emily Hernandez hit their vehicle on the front passenger side. Victoria โ€œVickieโ€ Wilson was killed in the crash and Ryan Wilson was seriously injured. Hernandez has been charged with two counts of driving while intoxicated. A preliminary breath test indicated that her blood alcohol content was .2 percent, which is more than twice the legal limit to drive in Missouri. On Jan. 10, 2022 Emily Hernandez pled guilty to entering and remaining in a restricted building for her activites on Jan 6, 2021. A February 2025 jury trial is set for her charges of DWI, death of another and DWI, serious physical injury.

A wrongful death lawsuit was filed by the Wilson family and it was settled in 2022. Judge Craig Hellmann approved the $125,000 settlement. Ryan Wilson received $70,000, their two children each received $15,000 and the Wilsons attorney received $25,000. Under the agreement approved Sept. 20, Hernandezโ€™s insurance company, AAA, will pay $100,000, the policy limit. Wilsonโ€™s husbandโ€™s insurance company, State Farm Mutual, will pay $25,000, which is the underinsured policy limit. Emily Hernandez will pay not money out of pocket.
