Sentence
Sentenced to serve concurrent terms of incarceration of twenty-one (21) months as to Count 1, twelve (12) months as to Counts 2 and 3, and six (6) months as to Counts 4, 5, and 6; the Defendant is further sentenced to serve concurrent terms of supervised release of thirty-six (36) months as to Count 1, and twelve (12) months as to Counts 2 and 3; he is ordered to pay a special assessment of $180.00 which consists of $100.00 as to Count 1, $25.00 as to Counts 2 and 3, and $10.00 as to Counts 4, 5, and 6; and $2,000.00 restitution payable to the Clerk of Court for the U.S. District Court for the District of Columbia for its disbursement to the victim, Architect of the Capitol; imposition of a fine waived.

- Just four months after he invaded the Capitol Building, Bender was involved in a single vehicle traffic crash, after which he admitted to having four drinks earlier in the day while on the job. Officers observed multiple beer cans and multiple firearms in the back of Bender’s vehicle, including a concealed handgun.
- Between March of 2019 and May of 2021, Bender committed, or is accused of committing, crimes on four separate occasions, resulting in 16 separate charges (not including traffic convictions). Bender was arrested for his first DWI offense on January 26, 2021, almost three weeks after his participation in the assault on the Capitol building.
- Unresolved case in Stafford County, Virginia, arising from conduct on July 7, 2020. Bender allegedly stole a piece of heavy construction equipment and misused it for nearly 45 minutes, causing extensive damage to an excavator, track loader, and nearby items. He was arrested on November 28, 2022, when forensic evidence tied him to the crimes. Bender has been charged with five offenses, including grand larceny and unauthorized use of a motor vehicle.
