Sentence
Sentenced to a term of Sixty (60) Months Probation, on each count, all counts to run concurrently, including 180 days of Home Incarceration with Location Monitoring. Special assessment of $100, as to each of Counts 1s and 2s; $25 as to each of Counts 3s and 4s, and $10, as to each of Counts 5s and 6s, for a total of $270. Restitution in the amount of $2000. Defendant shall complete 100 hours of community service as approved by the Probation Office.
Criminal History
In 1991, at the age of 19, Council was charged with the destruction of property for smashing the rear window of a resident assistantโs car while in a drunken anger. Council pled no contest to the charges.
In June 2021, Council was charged with domestic battery of an elderly (over the age of 65) victim, Councilโs father. The charges were dropped by the local prosecutors when the victim made it clear that he would not cooperate.
Pretrial services for his charges on Jan 6, 2021 filed reports of noncompliance on July 27, 2021, as well as on November 12, 16, and 30, 2021. During the period of noncompliance that led to the November 16 report, Council barricaded himself in a hotel room, refused to come out, and caused thousands of dollars of damage. The level of danger to the public and private property was such that a local police response was required.
Pretrial services filed reports of noncompliance on March 16, 23, and April 6, 2022. The reports voice concerns regarding Councilโs mental health and violent tendencies.
