In June 2004, Witzemann was sentenced to 364 days’ imprisonment (suspended) and 544 days’ probation for resisting, evading, and obstructing an officer. Additional charges of aggravated assault upon a peace officer and assault against a household member were dismissed. In April 2012, Witzemann was arrested for battery, but that charge was subsequently dismissed
